IN ALL CASES, ASPIFY’S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU, IF ANY, FOR THE PRODUCTS OR SERVICES GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages; if such laws apply to you, liability is limited to the fullest extent permitted by law.

16. Governing Law & Dispute Resolution
These Terms are governed by the laws of India / Kerala, without regard to conflict of laws principles. For disputes that cannot be resolved informally, you and Aspify agree to submit to the exclusive or non‑exclusive jurisdiction of the courts located in Malappuram, Kerala, India.

If your local law provides mandatory consumer protections, nothing in these Terms is intended to override those protections.

17. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

18. Changes to Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last revised” date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

19. Miscellaneous
Entire Agreement: These Terms and any policies posted on the Service constitute the entire agreement between you and Aspify regarding the Service.
Waiver: Failure by Aspify to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision.
Assignment: You may not assign your rights or obligations under these Terms without Aspify’s prior written consent. Aspify may assign these Terms at its discretion.
